BOOKING TERMS & CONDITIONS
Tours are operated by Cherokee Tours in Nairobi, Kenya, hereafter referred to as ‘CT’. The agent or client herein referred to as the ‘Client’ shall be deemed to have accepted that he/she has read and understood these conditions and have agreed to be bound by them, once they make a booking with Cherokee Tours.
Prices
Published prices are based on costs at the time of booking. CT reserves the right to change and or increase the cost of your holiday should the government impose new taxes, increase existing taxes or increase of fuel charges. You will therefore be informed by us of any such increases at the earliest possible date.
Payments
A deposit of an amount requested by CT will be required to confirm a tour. Upon receipt of the deposit, we will send you an invoice that will serve as booking confirmation and a remainder of the tour cost balance which is payable not less than 45 days prior to the commencement of the tour. Should you make a booking in less than 45 days before departure, we will require a full payment for the tour cost. CT reserves the right to cancel any booking without notice on the expiration of the due date. CT will also upon request thereafter, re-quote the tour and may impose a surcharge as a result.
Cancellation
- If you cancel your booking more than 45 days before tour departure, your deposit will not be refunded, unless you make another booking for an alternative date, where the Company may charge you an administration fee.
- If you cancel your booking 36 days prior to the start of a tour, a cancellation fee of 10% will be charged.
- If you cancel your booking 35-15 days prior to the start of a tour, a cancellation fee of 25% will be charged.
- If you cancel less than 45 days but more than 30 days prior to tour departure a refund of 50% will be charged.
- It is strongly recommended that you take out insurance against irrecoverable cancellation costs. All cancellations must be made in writing. Whether or not the deposit was received, the deposit will remain due in case of cancellation.
- We reserve the right to cancel the contract between us for any reason prior to your payment of the full price of the holiday, whereupon we will refund in full (other than due to your default in paying) any monies that you have paid us. After full payment has been made, we will only cancel the contract if circumstances beyond our control make it unavoidable. Such circumstances include, but are not limited to civil or political unrest, terrorism or natural disasters. In the unlikely event that such circumstances should arise, we will contact you immediately and offer you the choice of an alternative of equivalent quality or a full refund of all monies paid. No additional compensation will be paid over and above the total sum received from you.
Travel Insurance
Travel Insurance is mandatory and all clients are advised to obtain a comprehensive travel insurance policy before travel and share the same with the travel agency. The protection should cover the entire duration of the tour and should be against personal injury, medical expenses, repatriation expenses, loss of luggage and the expenses associated with cancellation of the tour. Also the protection should cover all hospital expenses, doctor fees and repatriation costs which will be the client’s responsibility, and therefore the Company shall not be liable for any refund of the tour cost.
Changes to the Itineraries
CT is unlikely to make any changes to the Client’s itinerary, but in case of such changes or alterations, we will advise the Client of them at the earliest possible date. CT reserves the right to alter the itinerary after departure, without payment of compensation if it is in the interest of the Client to do so. CT will not be responsible for losses or expenses from sickness, quarantine, weather, Acts of God, strikes, civil disturbances, wars, custom regulations or other material external circumstances beyond the CT’s control.
Liability
- Client’s bookings are accepted on the understanding that they appreciate the possible risks inherent in safari travel with the proximity to wild animals and that they undertake the tour at their own volition.
- Where the Client suffers death or personal injury as a result of an activity forming part of the tour arrangements booked with the Company, the Company shall forward all claims presented to it to its insurers to investigate and ascertain liability The Client understands that the Company’s insurers shall not accept liability if there has been no fault on the Company’s part or its suppliers and the cause was either the Client’s fault, the actions of someone unconnected with the tour or one which neither the Company nor its suppliers could have anticipated or avoided even with the exercise of all due care.
- Any additional expenses are incurred as a result of delay, accident or disruption of the tour beyond our control by acts of nature; such expenses are solely to be borne by the Client.
- In regard to activities such as Hot Air Ballooning, scuba diving, horse/boat riding and other hazardous pursuits, the Client will appreciate that by their nature, these activities carry risks. The Client hereby agrees to be personally responsible for engaging in these activities and it is the Clients duty to check carefully with their travel insurance on any clauses that may apply when intending to engage in any activity that could be considered hazardous in any way.
Transportation
CT shall in respect to transport, shall provide safari minibuses and other vehicles, aircraft or coaches, as it considers necessary to transport you at its discretion from time to time. CT reserves the right to outsource such mode of transport as may be necessary.
Clients Health
Upon booking, the Client confirms that he or she is in good health to undertake the said tour and that he/she will declare any pre-existing medical condition or illness to CT, and has made arrangements for the provision of drugs or other cause treatment which may be required during the tour. The Client is required to provide a medical statement from a GP to confirm that they are fit for this type of adventure travel. The must take all necessary vaccinations as are required or generally recommended by the country of visit prior to travel.
Travel Documents
The Client should have all travel documents i.e., valid passport, visa/ permits and vaccination certificates. CT will not be responsible for any changes / requirements for visas, and will not be held responsible for the failure of the Client to obtain the necessary documentation.
Complaints
All complaints in regard to travel arrangements will be dealt with promptly after we are informed by the Client. In any case where the issue cannot be resolved during the tour, please contact us via email within 7 days after the tour as it will not be possible to accept liability in respect of claims we receive after that.
Claims & Jurisdiction and Law
All matters concerning the above conditions shall be subject to Laws of the Republic of Kenya. The clients submit to the exclusive jurisdiction of the Courts of Kenya, which shall be the sole forum for the hearing of any claims.
